I had a conversation earlier this week with our art gallery, who is working on a project to photograph the objects in their collection and make them available on the gallery website through the PastPerfect web interface. They are wondering how to handle images of art where the artist still holds the copyright and whether or not those images should be made available.

 

They’ve received a range of advice from “Fair use, it’s all fine!” to “clear everything through VAGA”. I know that CAA has a code of best practice, and I found the Association of Art Museum Director’s guidelines, but I’m wondering if anybody has real-life policies or practices from your institution that you’re willing to share. If you work in a place that puts images online of art in your institution’s collection, do you put up images of otherwise-copyrighted work, and if so, do you seek permission, or are you relying on Fair Use?
