How can cultural institutions respect the moral rights of artists protected through VARA when faced with possible modifications to spaces that include their work?  What role do the exceptions within VARA play in maintaining this balance?


As one of the few “moral rights” within US copyright law’s economic model, Section 17 U.S. Code § 106A -- known as the Visual Artists Rights Act (or VARA), has aimed to safeguard the intellectual property rights of artists by protecting the “moral integrity” of their work. With some modest success, VARA has served to protect artists right of integrity by either preventing the modification or destruction of their physical work; or more often, offering monetary compensation from the owners of the physical piece. As a society that encourages the production of creative goods by artists, one would guess that any ambiguity in case law would be minimal. However, VARA can create profound dilemmas for both artists and the owners of their works; particularly cultural institutions faced with finding a balance between showcasing art while maintaining and developing their physical spaces. For example; artists may be faced with proving the validity of their artistry as something of “recognized stature”; while an owner of a work must face both the moral and legal ramifications for the modification or removal of a work under circumstances that may be out of their control.


This presentation will address key points and exceptions within VARA through an analysis of the law and and a background of important cases. Some of the questions that will be addressed are: what grounds does an institution have when faced with a VARA case? What level of responsibility does an institution take on when presenting a visual work of art within their physical space? And how do exceptions and limitations within the law serve to protect both sides, and how can some semblance of resolve be found within these types of cases?


Kiowa Hammons has over 10 years in rights clearance and research, with an emphasis on art and culture.  He is currently the Rights Clearance Coordinator at The New York Public Library; focusing primarily on intellectual property research for the institution’s collections, metadata implementation, and library policy. Previously Kiowa worked in rights clearance at Penguin Random House, and for over 5 years in rights management for the Whitney Museum of American Art--facilitating image reproduction requests and overseeing photography of their permanent collection and exhibitions. His experience at the Whitney as well as interning for a number of art galleries and independent publishers in New York and San Francisco forged a strong passion for the arts; which he has taken into both his professional career and creative practice. Kiowa hold a Masters in Library and Information Science from the Pratt Institute, with an emphasis on Information Policy, Art Librarianship, and Archives.
