Happy Friday, colleagues! 

I just received an interesting reference question, especially for it to be 4pm on the Friday of Labor Day weekend.

This patron is interning at a local historical society and they have a copy of a photo that the patron wants to use in a publication for said historical society. The photo is over 100 years old. The people in the photograph are obviously not alive, but they do have living descendants. The descendants have a copy of the photo and the historical society has one, but neither are the originals. The photo does not appear to be made by a professional photographer.

Is there copyright restrictions on this that the patron needs to be worried about for publication? Does credit go to the historical society or the family? 

I know this is murky waters before a holiday weekend, but I appreciate any help you can provide!
