“Standards and Strategies for Fair Use Decisions inside Libraries and Universities: Law, Interpretations, Best Practices, and Risks”
The meaning of “fair use” of copyrighted works is famously subject to variable interpretations.
That flexibility is an opportunity to engage fair use for new and unexpected needs, yet the law’s
unsettled nature is also a challenge for librarians, educators, and lawyers who must give it
practical and reliable meaning. This conference goes beyond the question “What is Fair Use?”
It is instead about the means for making fair use decisions in an environment of unresolved law
and changing needs and technologies. A new report on “Best Practices in Fair Use” for libraries
(from the Association of Research Libraries) is compelling a reexamination of how an institution
might draft policy and make responsible fair use decisions when the legal answer is seldom clear.
Presenters will offer an extraordinary range and depth of experience with making fair use
decisions for research, teaching, publishing, and other pursuits that are central to the academic
community.
