Agreed. The copyright owner still owns the copyright to the material. You will need to seek permission to make the copies.

Dear Copyright experts of ARLIS,
 
My Associate Dean asked me to find out the legality of copying a textbook that has been out of print since 1993 for use in a course packet.  If a book is no longer available commercially, is it legal to copy the entire work and sell it at cost of reproduction/binding at a campus bookstore?
