No, that’s not going to be considered fair use.

Subject: [ARLIS-L] Fair Use Question

Dear Copyright experts of ARLIS,

My Associate Dean asked me to find out the legality of copying a textbook that has been out of print since 1993 for use in a course packet.  If a book is no longer available commercially, is it legal to copy the entire work and sell it at cost of reproduction/binding at a campus bookstore?

Thanks,

Eric
