I have received several
requests to post the answers I received about reproducing images from a book. .
Here are the two answers I received:
“The cutoff date
right now is 1923. If the book is
published prior to 1923, the photographs are in the public domain and can be
used. If they're
1923 and after, then one needs to get permission. To know who to ask for permission, look
at the list of
illustrations
in the book -- usually the source will be listed and that's who you would
contact. If there's no source, I
would start by asking the publisher.”
“It probably
depends on the copyright holder. For example, if the images were from Andersen/Alinari, even though they were printed in 1915, they
probably still hold the copyright for those particular images. If you can find
a credit line for the images, it would be worth checking Art Resources to see
if they are providing US rights for the particular firm.”
Since there is such
interest in copyright and images, I would like to know if maybe ARLIS/NA could
do an online workshop/training. I also think it will be very useful to create on
the ARLIS/NA site a list of resources (in print and online) about images and
copyright issues. This, hopefully, will clear much of the confusion.
