Margaret et al:

We have been offering a public scanner at our library at the University of
Florida for almost a year now. The following regular caveat (which is also
posted at our photocopiers) is posted above the scanner:

"NOTICE WARNING CONCERNING COPYRIGHT RESTRICTIONS: The U.S. Copyright Law
(Title 17 U.S. Code) governs the making of photocopies or other
reproductions of copyrighted material. The person using this equipment is
liable for any infringement."

Then we also have a gentle reminder on the scanner itself that says, "Please
observe copyright laws and use your scans for educational purposes only."
This verbiage may not be legally sound, but at least it shows an effort and
our administration seems to be okay with it. Hope this helps.

Subject: Public scanners and copyright
I am requesting a scanner for public use in our branch library, and the
main library administration has expressed concerns about library
accountability for copyright violations by users of the scanner.  I had
assumed that a notice similar to the one we post on our copy machines
should be sufficient.  The ARLIS-L archive contains several postings about
scanner equipment, but not much about copyright issues related to public
scanners.  Are most libraries posting a standard notice?
