Interesting point Cris.
At OCAD, the Library has both a purchase and a rental budget for media
(because we're responsible for bringing titles in for use in the
classroom -- OCAD doesn't have a Media Centre). There is no such thing as an
educational exemption for classroom screenings of video or film media so
when we purchase or rent a title, it has to include "public performance
rights" -- The rights or "license" are usually for a set duration so after
5-years or so we have to purchase the performance rights all over again (or
relegate the tape to "home use only"). As I'm sure everyone knows, a "public
performance" is defined as two or more human beings watching a film or video
together, outside of the home.
It would be interesting to have a media librarian on the panel who can talk
about the many issues surrounding performance rights.....these are endlessly
debated here in Ontario by the Interfilm Consortium (university media
librarians).
Questions often arise such as - why isn't there an educational exception?
Who collects "performance rights" payments and under what authority? Where
does the money go? Who is accountable? Can library consortia work together
to "negotiate" educational exceptions or reduced license fees? etc.
