Yes, the CONFU document is a proposed set of guidelines not law as you
state; however, once endorsed it will dictate what most of us will be able
to do or won't be able to do in our institutions. Our administrators will
interpret it as law and will insist on its being followed as if it were law
to protect against potential lawsuits. A good case in point is the current
10% rule governing photo copying from books and articles which is just a
guideline, but most institutions adhere to it. As Chris Sundt suggests,
Kenneth Crews' book very carefully explains this.
I also fully agree with her that we need guidelines that are established
with our interests and needs in mind rather than one which are established
by others for our supposed benefit.
